Terms of Service

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

WorkFit IQ provides a self-administered career and cognitive diagnostic that analyzes your responses to questions about traits, preferences, motivations, and aptitudes, then generates a written profile, job-fit matches, and supplementary reports.

The Service is provided for educational and self-reflection purposes only. It is not a clinical psychological assessment, medical diagnostic, professional career counseling relationship, employment guarantee, or substitute for advice from a licensed professional. See our Disclaimer for details.

You may enter a name and email address to create a lightweight profile. At this time the Service stores your profile and diagnostic results in your browser’s local storage on the device you used to take the test. Clearing your browser data, switching devices, or using a different browser will not restore those results unless you have separately downloaded a copy.

You are responsible for the accuracy of the information you provide and for safeguarding access to any device on which your profile is stored.

Some features (including the full WorkFit IQ profile and certain add-on reports) are available only after purchase. Prices are listed in U.S. dollars on the Pricing page and may change at any time; the price at the moment of purchase is the price you pay.

Payments are processed by Stripe, Inc. and/or PayPal, Inc. By purchasing, you authorize the processor to charge your selected payment method and you agree to that processor’s terms. We do not receive or store your full payment card number.

Recurring subscriptions (when offered) renew automatically until you cancel. You may cancel at any time; cancellation takes effect at the end of the then-current billing period.

Our refund policy is described in full at /legal/refunds and is incorporated into these Terms by reference. In short: one-time purchases are refundable within 14 days of purchase if you contact us at support@workfitiq.com.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

The text, graphics, code, design, frameworks, scoring logic, and generated profile content are owned by WorkFit IQ or licensed to us, and are protected by copyright, trademark, and other laws. Your purchased profile is licensed to you for personal use; you may save, print, and share it with advisors but you may not republish, resell, or use it to train an AI/ML model.

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Reverse-engineer, scrape, or systematically copy the Service or its underlying scoring logic;
• Resell access to the Service or your generated profile;
• Bypass any access control, paywall, or rate limit;
• Submit responses on behalf of another person without authorization;
• Use the Service to train, fine-tune, or evaluate a machine-learning model without our prior written consent;
• Interfere with the operation of the Service or attempt to disrupt other users.

You retain ownership of the responses you submit. By submitting responses, you grant us a worldwide, royalty-free license to process them solely to operate the Service, generate your results, and improve the Service in aggregated or de-identified form. We will not sell your individual responses.

The Service integrates with third-party providers including, where configured, Stripe (payments), PayPal (payments), Resend (email delivery), Vercel or another hosting provider, and analytics or advertising networks (such as Google, Meta, LinkedIn, TikTok, X). Your use of those features is also subject to those providers’ terms. We are not responsible for third-party services.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE. CAREER, EMPLOYMENT, AND LIFE DECISIONS BASED ON THE RESULTS ARE YOURS ALONE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WORKFIT IQ, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless WorkFit IQand its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be highlighted on the site or notified by email where we have one. Continued use of the Service after the changes take effect constitutes acceptance.

These Terms are governed by the laws of [[Your state / country, e.g. Delaware, USA]], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of [[Your state / country, e.g. Delaware, USA]], and you consent to the personal jurisdiction of those courts. If binding arbitration is required by applicable law, the parties will arbitrate the dispute on an individual basis; class actions and class arbitrations are waived to the extent permitted by law.

These Terms, together with the Privacy Policy, Refund Policy, Disclaimer, and any purchase order, constitute the entire agreement between you and WorkFit IQ regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
